Terms & Conditions

The terms under which Klipwerks provides website design, hosting, and maintenance services to South African guesthouses and accommodation providers.

1. Agreement

These terms govern the relationship between Klipwerks ("we", "us", "our") and you ("client", "you") when you engage us to build, host, or maintain a website. By accepting a quote or paying an invoice, you agree to these terms.

2. Services

We provide:

  • Website design and build: A once-off service to create a direct-booking website tailored to your guesthouse or accommodation business.
  • Hosting and maintenance: An optional monthly service for website hosting, security updates, and content updates.
  • SEO optimisation: Included in builds. Ongoing SEO services available on selected plans.

3. Quotes and pricing

All quotes are valid for 30 days from issue date. Pricing is in South African Rand (ZAR). Once-off build fees cover the scope agreed in writing. Additional features or changes beyond the agreed scope are billed separately at an hourly rate communicated before work begins.

4. Payment terms

  • Build fee: 50% deposit to commence work, 50% on completion before the site goes live.
  • Monthly hosting: Billed monthly in advance. Due within 7 days of invoice.
  • Late payment: Hosting services may be suspended if invoices remain unpaid for 14 days. The website will be reinstated upon payment.
  • Payment methods: We accept payment via Yoco, Payfast, or direct EFT. Payment links are provided with each invoice.

5. Client responsibilities

To deliver your website on time, we need from you:

  • Accurate business information: name, address, contact details, room descriptions, rates, photos.
  • Content (text and images) within 7 days of request, or the project timeline may be extended.
  • Photos you own or have permission to use. Do not provide photos scraped from Booking.com or other platforms — you are responsible for copyright of content you supply.
  • Timely responses to queries and approval requests during the build.

6. Timeline

Standard builds are completed within one weekend of receiving all content and the deposit. Delays caused by late content or approvals will extend the timeline. We are not liable for delays caused by client-side factors.

7. Revisions

Each build package includes two rounds of revisions during the build phase. Additional revisions are billed at an hourly rate. Revisions after the site goes live are covered by monthly maintenance plans where applicable.

8. Intellectual property

  • Client content: You retain ownership of all content you provide (photos, text, logos). You grant us a licence to use it on your website.
  • Website code: Upon full payment, you own the website design and code. You may take it to any other host.
  • Our tools and templates: We retain ownership of underlying frameworks, templates, and tools used to build your site. You licence these as part of your website.
  • Portfolio use: We may display your website in our showcase portfolio unless you request otherwise in writing.

9. Hosting and maintenance

  • Monthly hosting includes: server hosting, SSL certificate, security updates, and daily backups.
  • Content updates (text, photo changes, rate updates) are included in Plus and Managed plans, limited to 2 updates per month.
  • We aim for 99.5% uptime but do not guarantee uninterrupted service. Maintenance windows are scheduled in advance.
  • We are not liable for downtime caused by third-party hosting providers, DNS issues, or factors outside our control.

10. Cancellation

  • Build fee: The 50% deposit is non-refundable once work has commenced. If you cancel before work begins, the deposit is refundable less an administration fee of R250.
  • Monthly hosting: Cancel anytime with 30 days written notice. No cancellation fees. Your website files will be made available for transfer.

11. Warranties and liability

  • We warrant that the website will function as described for 30 days after launch. Bugs reported within this period are fixed at no charge.
  • We are not liable for loss of revenue, bookings, or business resulting from website downtime, errors, or third-party service failures.
  • Our maximum liability is limited to the total amount paid by you for the service in question.
  • We are not liable for issues caused by client-supplied content, third-party plugins, or services outside our control.

12. Privacy and POPIA

We handle your personal information in accordance with the Protection of Personal Information Act (POPIA). See our Privacy Policy for details.

13. Refunds

Given the custom nature of website design, we do not offer refunds on completed work. If you are unsatisfied with the build, we will work with you to resolve issues within the revision scope. Hosting fees are refundable on a pro-rata basis for unused full months if cancelled.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the South African courts, unless we agree otherwise in writing.

15. Changes to terms

We may update these terms. Changes will be posted on this page. Continued use of our services after changes constitutes acceptance.
